SMS Messaging Terms and Conditions Last Updated: June 12, 2025

1. Introduction
Moore & Welliver (“Company,” “We,” “Us,” or “Our”) uses SMS strictly to receive direct communication from third parties. SMS messages are initiated solely by third parties, and we do not send promotional messages. By sending SMS communications to us, you agree to these Terms and Conditions. If you do not agree, please refrain from sending SMS communications.

Customers may opt-in to receive SMS communications by:
- Opt-in: Customers can opt-in by texting us “START”.
- Help: If you need help with SMS Messaging, text “HELP” to 503-357-3191. You may also contact us directly by phone at (503) 357-3191.
- Message & Data Rates: Standard carrier message and data rates may apply.

2.2 Opting-Out
Customers may opt-out of SMS communications at any time by:
- Opt-out: Customers may opt-out at any time by replying “STOP” or contacting us via phone at 503-357-3191, or email at office@moorewelliver.com. You will no longer receive SMS messages from us unless you re-enroll.
- Help: If you need assistance with SMS messaging, text “HELP” to 503-357-3191, or give us a call at (503) 357-3191.
- Message & Data Rates: Standard carrier message and data rates may apply.
Upon opting out, you will no longer receive SMS messages from us, except for a final message confirming your opt-out request.

3. Nature of SMS Communication
- No bulk messaging: We do not send marketing, promotional, or mass SMS messages.
- Responsive communication only: Our SMS is used to respond to third party contacts only.

Standard message and data rates may apply based on your wireless provider’s plan. You are responsible for any charges incurred from your carrier.

5. User Responsibilities
By using our SMS Service, you agree to:
- Provide accurate and up-to-date mobile contact information.
- Understand that message delivery depends on your carrier and mobile network.
- Only use SMS communication with us relating to services our office provides.

6. Limitation of Liability
To the fullest extent permitted by law, Moore & Welliver shall not be liable for:
- Any delayed or undelivered messages due to network issues.
- Any fees charged by your mobile carrier.
- Any damages arising from SMS communication, including but not limited to missed messages or technical failures.

7. “AS IS” and “AS AVAILABLE” Disclaimer
Our SMS service is provided on an “AS IS” and “AS AVAILABLE” basis. We make no warranties, express or implied, regarding message delivery, accuracy, or uninterrupted service.

8. Governing Law
These Terms and Conditions shall be governed by and construed under the laws of the State of Oregon, excluding conflict-of-law principles.

We reserve the right to update these Terms at any time. Material changes will be communicated via our website or direct notification.
